Effective Dec. 15, 2025, the Jacksonville Port Authority (JAXPORT) will be revising its Terminal Tariff to include new rule #31-018: Battery Energy Storage Systems Limitations and Penalties (see below).

BATTERY ENERGY STORAGE SYSTEMS LIMITATIONS AND PENALTIES
Battery Energy Storage Systems (BESS), including Lithium-Ion battery packs, are considered hazardous cargo under rule 31-185 and are subject to additional requirements including applicable federal, state, and local regulations as required under rule 31-290. This rule applies to all BESS units placed on JAXPORT terminals for the sole purpose of import or export cargo movement and shall not be used as a long-term storage solution. BESS units are limited to a maximum of seven (7) calendar days on JAXPORT terminals, inclusive of weekends and holidays. No extensions of time will be granted for BESS units and any unit remaining beyond seven (7) days shall be considered unauthorized hazardous storage. Long-term, indefinite, or non-waterborne transit of BESS units is strictly prohibited.
JAXPORT reserves the right to refuse acceptance, require immediate removal, isolation, or order evacuation of any BESS unit under rules 31-060, 31-185 and 31-290. Beginning at 0001 hours on the eighth day, a penalty of $10,000 per BESS unit per day will be assessed until the unit is removed from JAXPORT terminal property. The penalties accrue per calendar day, including weekends and holidays, and will be billed to the terminal operator in accordance with rule 31-020.
